Welcome to Simply Daily! The terms “we”, “us” and “our” refer to Simply Daily. By using and accessing any part of the simplydaily.co.uk website (the “Site”), and/or placing an order with us you are deemed to accept these Terms and Conditions, and our Privacy Policy. Please read these Terms and Conditions carefully, as they include important information about your legal rights and liabilities. If you do not agree to these Terms and Conditions or Privacy Policy in full, please do not use the Site.

These Terms and Conditions on this Site DO NOT affect your statutory rights as a consumer.

SECTION 1 - ACCESS AND ACCOUNT 
By agreeing to these Terms and Conditions, you must be over 18 years old, and you have given us your consent to allow any of your minor dependents to use the Site on devices you own, purchase or manage. 
To use the Site, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide is correct, current and complete and that you have all rights necessary to provide this information. 
You should always check that the contact information you provide is correct before creating a customer account or proceeding to payment.
When you create a customer account, you will automatically be joined to Simply Daily Rewards, our free customer rewards programme. Your participation in Simply Daily Rewards is subject to the Simply Daily Rewards Terms and Conditions.
As a customer you are solely responsible for maintaining the security of your customer account and for all of your account activity. 
Each account is for a single user only. Discounts, promotions, rewards or offers may be limited to one per customer, account, household or order, where stated.

SECTION 2 - OUR PRODUCTS AND SERVICES
We make every effort to provide an accurate representation of our products and services in our Site. However, please note that the appearance or colours of products may differ from how they may appear on your screen due to the type of device you use to access the Site and your device settings and configuration. 
We also make every effort to ensure that all product images on the Site are as accurate as possible. However, there may be times when the product you receive may vary slightly in appearance from the images shown, for example due to differences in packaging, finishes, or minor updates made by the manufacturer. Any such difference will not affect the core features and quality of the products. 
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products and services that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.
We reserve the right to refuse a refund on an item that close to or passed the best before date, where this has been correctly displayed.

SECTION 3 - ORDERS 
The minimum order value is £20, an order cannot be placed below this threshold.
When you place an order, you are making an offer to purchase. We reserve the right to delay or decline your order for any reason at our sole discretion. Your order is not accepted until we have emailed you to confirm the dispatch of your order. We must receive and process your payment before your order is accepted. 
In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e mail, billing address, and/or phone number provided at the time the order was made. 
You represent and warrant that any purchases you make through our website are for your personal or household use, or intended as a gift, and not for commercial resale or export. We reserve the right to cancel or refuse any order that we believe has been made for commercial purposes, resale, or export in breach of this condition, and we may pursue any other remedies available to us under law.

SECTION 4 - PRICING AND PAYMENT  
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. The prices of shown on the Site are inclusive of VAT but exclusive of delivery charges.
Payment can be made by most major credit/ debit cards, by completing the relevant details on the checkout page. By using any payment method for your order, you confirm that the method being used is yours or that you are authorised to use it. We are not responsible for the card issuer or bank charging the holder of the card as a result of us processing your payment.

SECTION 5 - AVAILABILITY
While we make every effort to ensure that our stock availability is correct, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we will attempt to contact you using the details you have provided to us to ask you how you wish to proceed. We may, at our discretion, process any part of the order which is available or cancel the order. Where goods are out of stock, we will refund you the price paid for such goods in accordance with our Return and Refund Policy.

SECTION 6 - SHIPPING AND DELIVERY 
We aim to process and dispatch all orders promptly. Delivery areas, methods, costs, and estimated timeframes are outlined in our Delivery page.
We are not liable for shipping and delivery delays. Estimated delivery times are provided for guidance only and may vary depending on courier availability, seasonal demand, or factors outside of our control. 
Ownership of the goods transfers to you once we have received full payment. Responsibility and risk transfer to you upon delivery.
It is your responsibility to ensure that the delivery address provided at checkout is correct. We accept no responsibility for failed or delayed delivery due to incorrect or incomplete addresses. If you fail to take delivery and the courier charges us for failed, returned, or stored consignments, we reserve the right to pass these charges on to you.
For orders delivered by third-party couriers, if your order arrives damaged, incomplete, or does not arrive at all, you must notify us within 24 hours of delivery or the expected delivery date so that we can investigate with the courier. Failure to report within this timeframe may limit our ability to resolve the issue or to provide a replacement or a refund.
We will not be liable for any lost or stolen packages once the courier has confirmed delivery to the location you selected, including delivery to a safe place, a neighbour, any parcel-forwarding address, or any parcel collection point. In these circumstances, we are not obliged to provide a replacement or a refund.

SECTION 7 - CANCELLATIONS, RETURNS AND REFUNDS
Please review your order carefully before submitting, as we may be unable to amend or cancel an order after it has been placed. This includes changes of items and/or delivery address. If you wish to amend or cancel an order, please contact us as soon as possible.
Once an order has been handed to or dispatched by a third-party courier, it cannot be amended or cancelled. 
If you have received the order, you may still return it if you change your mind, in accordance with our Return and Refund Policy. Refunds will only be issued once we have received the returned items and may be subject to the deduction of any applicable courier or return shipping charges.

Please read our Return and Refund Policy for details on how to return items and obtain refunds. This policy is in addition to, and does not affect, any statutory rights to which you may be entitled.

SECTION 8 - THIRD PARTY LINKS 
The Site may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third-party functionality). We are not responsible in any way for content outside the Site. We are not liable for any harm or damages related to your access of any third party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully their privacy policy and terms and conditions, and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third party products and services should be directed to the third-party.

We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms and Conditions. 
You agree that your Feedback will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your Feedback will not contain libelous or otherwise unlawful, abusive or obscene Feedback, or contain any computer virus or other malware that could in any way affect the operation of the Site or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Feedback. You must not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Site without our prior written consent. Except as expressly provided herein, nothing in these Terms and Conditions grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Simply Daily, Shopify or any third party. Unauthorised use of the Site may be a violation of intellectual property laws. All rights not expressly granted herein are reserved by us. Simply Daily’s names, logos, product and service names, designs, and slogans form part of our business identity and must not be used without our prior written permission. References on the Site to Shopify or other third parties remain the property of their respective owners.

The information presented on or through the Site is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. To the fullest extent permitted by law, the services and all products offered through the Site are provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. To the fullest extent permitted by law, Simply Daily, and our service providers, any of its directors, officers, employees, shareholders, or other representatives will not be liable to you or a third party for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, loss of profits, revenue, savings, data, business opportunity, goodwill, or reputation, whether based in contract, tort (including without limitation negligence), pre-contract or otherwise, arising out of or in connection with the use of the Site or the information, content, materials, services or products included on the Site. Our total liability to you in connection with any order shall not exceed the amount you have paid to us for the relevant product or service.
Nothing in these Terms and Conditions shall limit any rights you might have as a consumer under applicable law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury caused by negligence.

You may not delegate, transfer or assign any of your rights or obligations under these Terms and Conditions without our prior written consent. We may transfer, assign, or delegate these Terms and Conditions and our rights and obligations without consent or notice to you.

The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. We reserve our rights in respect of these Terms and Conditions at all times.

You may access and use the Site for lawful purposes only. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms and Conditions.

These Terms and Conditions and any policies posted by us on this Site constitutes the entire agreement and understanding between you and us and governs your use of the Site.

By using the Site, you agree to indemnify and hold harmless Simply Daily, and our service providers, any of its directors, officers, employees, shareholders, or other representatives from any losses, damages, liabilities or claims relating to any breach of these Terms and Conditions by you. Such indemnities to include, but not be limited to all legal costs and otherwise, all other expenses, damages or settlements arising from your breach of these Terms and Conditions.

If you breach these Terms and Conditions and we take no immediate action, we will still be entitled to use its rights and remedies in the future or in any other situation where you breach the Terms and Conditions.

These Terms and Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts.
